At Varlack Legal Services, we have experience in all levels of appeals in various areas of law.  In simple terms, an appeal is a petition filed by a party to a higher court to ask for review of a decision that he/she does not agree with.  In California, appeals usually start at the Court of Appeals, which is divided into six districts and progress to the Supreme Court in rare cases.

At the federal level, appeals from the United States District Courts in the State of California are made to the U.S. Ninth Circuit Court of Appeals, and in rare cases to the U.S. Supreme Court.

The appeals process usually involves an opening brief and reply, a closing brief and, if requested, oral argument.  One of the key differences between the California Superior Court, where cases usually start, and the Appellate Courts is that, at the appellate level, the cases are usually decided by a three-judge panel, whereas at the Superior Court level a single judge decides most issues.

Constitutional Law  

Regarding constitutional law, every person has inalienable rights that our founding fathers bestowed to all persons in America.  Our rights include the right to free speech, religious freedom, freedom of association, freedom in our person, and the right to due process and equal protection of law, to name a few.  When the government acts to infringe on these rights this can be construed as a violation of constitutional law and you may be able to seek redress for your injuries.
